Terms of Service

Please read these terms carefully before using our platform.

1 Introduction & Acceptance

1.1 Agreement Overview

These Terms of Service ("Terms", "Agreement") constitute a legally binding contract between you (the "User", "Customer", "you") and IP Market β„’, statutory name PeaceWeb B.V., governing your access to and use of the IP Market platform, including all services, features, content, and applications offered through our website and platform (collectively, the "Services"). References to "IP Market", "we", "us", or "our" refer to IP Market β„’.

By accessing, browsing, or using the IP Market platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy, Cookie Policy, Acceptable Use Policy, and any other policies referenced herein. If you do not agree to these Terms, you must immediately cease using our Services.

1.2 Service Description

IP Market operates as an intermediary marketplace platform that facilitates transactions between:

  • β€’ Lessees: Organizations seeking to lease IPv4 address space for legitimate business purposes
  • β€’ IP Holders: Organizations that own or control IPv4 address resources and wish to monetize unused or underutilized IP address space

IP Market provides the infrastructure, compliance tools, and marketplace functionality to enable these transactions but does not own, control, or directly lease the IP addresses listed on the platform.

1.4 Modifications to Terms

IP Market reserves the right to modify, amend, or update these Terms at any time at our sole discretion. We will provide notice of material changes by posting the updated Terms on our website with a revised "Last Updated" date, sending email notification to your registered email address for significant changes, and displaying a prominent notice on the platform dashboard.

Your continued use of the Services after any modifications constitutes your acceptance of the updated Terms. If you do not agree with the modifications, you must discontinue use of the Services and may terminate your account in accordance with Section 11.

2 Account Registration & Eligibility

2.1 Eligibility Requirements

To register for and use IP Market Services, you must meet all of the following criteria:

  • β€’Be a legally registered business entity in good standing in your jurisdiction
  • β€’Have the legal authority and capacity to enter into binding contracts
  • β€’Be at least 18 years of age (or the age of majority in your jurisdiction)
  • β€’Not be located in, or a resident of, any country subject to international sanctions or embargoes (see Section 2.4)
  • β€’Not be listed on any government prohibited or restricted party lists
  • β€’Have a legitimate business purpose for using IP address resources
  • β€’Accept full financial and legal responsibility for all activities under your account

2.2 Registration Information

During registration, you must provide accurate, complete, and current information, including business details (legal business name, registration number, and jurisdiction), tax information (VAT/Tax identification number where applicable), contact information (primary business address, phone number, and email address), authorized representatives, and technical contacts (NOC and abuse contact information).

You agree to promptly update your account information to maintain its accuracy. Failure to provide accurate information or to update outdated information may result in account suspension or termination.

2.3 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials, all activities that occur under your account, implementing appropriate security measures including strong passwords and two-factor authentication, and immediately notifying IP Market of any unauthorized access or security breaches.

IP Market will not be liable for any losses arising from unauthorized use of your account, whether with or without your knowledge. You may be held liable for losses incurred by IP Market or other users due to unauthorized use of your account.

2.4 Country Restrictions and Sanctions

IP Market is unable to provide services to individuals or entities located in, or residents of, certain countries due to international sanctions and export control regulations. Account registration is prohibited for the following countries:

  • βœ•North Korea (KP) - UN Security Council Resolutions, EU/US comprehensive sanctions
  • βœ•Iran (IR) - EU Council Regulation 267/2012
  • βœ•Syria (SY) - EU Council Regulation 36/2012
  • βœ•Cuba (CU) - US embargo, EU restrictive measures
  • βœ•Russia (RU) - EU Council Regulation 269/2014 (since 2022)
  • βœ•Belarus (BY) - EU Council Regulation 765/2006

These restrictions are based on the Dutch Sanctiewet 1977 (Netherlands Sanctions Act), EU Common Foreign and Security Policy, and UN Security Council Resolutions.

Registrations from certain high-risk countries may require additional verification, including phone verification via SMS. IP Market reserves the right to update this list at any time to comply with applicable sanctions and export control regulations.

3 Know Your Customer (KYC) & Verification

3.1 KYC Requirements

To comply with anti-money laundering (AML) regulations and ensure platform security, IP Market implements a risk-based KYC verification process. KYC verification may be required upon account registration for certain high-risk jurisdictions, when transaction volumes exceed specified thresholds, when suspicious activity is detected, at IP Market's discretion for security or compliance purposes, and as required by applicable laws and regulations.

3.2 Required Documentation

KYC verification may require submission of business registration documents (certificate of incorporation, business license, or equivalent), identity verification documents (government-issued photo ID for authorized representatives), proof of address documents (recent utility bill, bank statement, or official government correspondence dated within 3 months), Ultimate Beneficial Owner (UBO) information, financial information and bank account verification documents, and for IP holders, proof of legitimate ownership or authorization to monetize IP resources.

3.3 Verification Timeline & Consequences

Once KYC verification is requested, you must submit complete documentation within 14 calendar days. During the verification process, existing services will continue uninterrupted, new transactions may be restricted or require additional approval, and payouts may be temporarily held pending verification completion.

Failure to complete KYC verification within the specified timeframe may result in account suspension or limitation of Services, withholding of payouts until verification is complete, and termination of account for persistent non-compliance.

4 IPv4 Address Monetization

4.1 Monetization Model

IP holders may list their IPv4 address resources for lease through the IP Market platform. IP holders set their own monthly lease prices for their resources. IP Market charges a 10% platform fee on all successful leases, deducted from the IP holder's earnings. There are no upfront costs to list IP resources on the platform. IP holders receive 90% of the lease price paid by lessees.

4.2 Listing Requirements

To list IP resources for monetization, IP holders must provide proof of legitimate ownership or authorization to lease the IP resources, ensure IP resources are clean (not blacklisted or associated with abuse), maintain accurate WHOIS and IRR (Internet Routing Registry) records, ensure resources comply with relevant RIR policies, and provide valid LOA (Letter of Authorization) or equivalent documentation when required.

4.3 Lease Commitment Period

Once an IP resource is leased, IP resources cannot be removed from active leases for a minimum of 90 calendar days from the lease start date. After the initial 90-day period, IP holders may request removal with 30 days' advance notice. Immediate removal may be permitted only in exceptional circumstances (e.g., legal requirements, RIR policy violations) and requires IP Market approval. Unauthorized or premature removal may result in financial penalties, withheld earnings, and potential account suspension.

4.4 Payout Terms

Payouts are processed on the 1st day of each month for earnings credited at least 14 calendar days prior. Earnings received after this cutoff date will be included in the following month's payout. IP holders may choose from monthly (default), quarterly, semi-annual, or annual payout schedules. A minimum balance of €50 is required for payout processing.

Payout Method

All payouts are made exclusively via bank transfer to your verified bank account:

Bank Transfer (IBAN/SWIFT)

Payouts are sent via SEPA bank transfer for accounts within the European Economic Area (EEA), or via international wire transfer (SWIFT) for accounts outside the EEA. You must provide valid IBAN details (for EEA) or SWIFT/BIC code along with your bank account number (for non-EEA) to receive payouts.

Processing times vary: SEPA transfers typically complete within 1-2 business days; international wire transfers may take 3-5 business days depending on the receiving bank and country.

5 IPv4 Address Leasing

5.1 Lease Terms

All IP address leases have a minimum term of 1 calendar month, unless otherwise specified in a custom agreement. Leases automatically renew on a monthly basis unless the lessee provides cancellation notice at least 7 days before the renewal date, payment is not received by the due date, or either party terminates the lease in accordance with these Terms.

5.2 Billing & Payment

Invoices are issued 14 calendar days before each renewal date. All prices are in Euros (EUR). All payments are non-refundable except in cases of documented platform errors or as required by applicable consumer protection laws.

Payment Authorization: By providing payment information, you authorize IP Market to charge the applicable fees to your chosen payment method. For recurring leases, you authorize IP Market to automatically charge all fees until you cancel your lease.

Billing Entity: All charges will appear on your bank or credit card statement as PeaceWeb Operating Group (or abbreviated forms such as PEACEWEB OPERAT GROUP or PEACEWEBOG). For more information, see our Billing Entity page.

Accepted Payment Method

Credit Card

We accept all major credit cards supported by Stripe, including Visa, Mastercard, American Express, Discover, Diners Club, and JCB.

You may add multiple credit cards to your account. Cards are prioritized in the order you specify. If your primary card fails during Auto-Pay, we will automatically attempt to charge your secondary cards in priority order until payment succeeds or all cards have been exhausted.

5.3 Auto-Pay and Automatic Billing

IP Market offers an Auto-Pay feature that automatically charges your payment methods for unpaid invoices. When enabled:

  • β€’Auto-Pay runs automatically every 2 hours and attempts to charge invoices due within 8 days
  • β€’Your primary payment method (priority 1) is charged first
  • β€’Fallback charging: If your primary method fails, Auto-Pay automatically attempts your secondary payment methods in priority order until payment succeeds
  • β€’Failed payments (across all methods) will be retried daily at 09:00 CET, with a maximum of 3 retry attempts per method

You can enable or disable Auto-Pay at any time through your account settings. Disabling Auto-Pay does not relieve you of the obligation to pay invoices by their due date.

Note: By enabling Auto-Pay and providing payment methods, you authorize IP Market to charge all saved payment methods (in priority order) automatically for all outstanding invoices without requiring additional approval for each transaction.

5.4 Invoice Lifecycle and Non-Payment Consequences

The following timeline applies to all invoices:

Payment is due. If Auto-Pay is enabled, automatic charge is attempted on your saved credit card(s).

Platform access may be restricted. Payment reminders are sent via email.

Affected services (IP leases) are suspended. Access blocked until payment is received.

Automatic Card Charge (Day 14)

IP Market will attempt to charge your card on file regardless of whether Auto-Pay is enabled.

Termination & Collections (Day 30)

Services permanently terminated. Invoice sent to collections. Payment can no longer be made through the platform.

Important: Collections Notice

Once an invoice is sent to a collections agency, you must deal directly with that agency. Additional collection costs (minimum €40 per Dutch law) and statutory commercial interest (8% per year for B2B) will apply.

5.5 Payment Statement Descriptors

IP Market β„’ (statutory name: PeaceWeb B.V.) is the merchant of record for all transactions. If you do not recognize a charge, please contact billing@ipmarket.io before disputing with your bank.

5.6 Stripe Connect Payment Processing

IP Market uses Stripe Connect to process payments and facilitate payouts to IP holders. By using our platform:

  • β€’Payments from lessees are processed through Stripe's secure payment infrastructure
  • β€’IP holders receive payouts via Connected Accounts on Stripe Connect
  • β€’IP holders must complete KYC/KYB verification through Stripe to receive payouts
  • β€’Ultimate Beneficial Owners (UBOs) with 25%+ ownership must be disclosed to Stripe
  • β€’By using the platform, you agree to Stripe's Connected Account Agreement

PeaceWeb B.V. (operating as IP Market β„’) remains the merchant of record for all transactions processed through IP Market β„’. Stripe acts as our payment processor.

5.7 Collections and Debt Recovery

When an invoice remains unpaid for more than 30 days after its due date, the debt is automatically transferred to a collections agency. The collections agency will be selected based on your country of residence as registered in your account profile to ensure effective debt recovery under applicable local laws.

Once transferred to collections:

  • β€’Payment can no longer be made through the IP Market platform
  • β€’You must communicate and settle directly with the assigned collections agency
  • β€’The collections agency will add their collection fees to the outstanding amount
  • β€’Extrajudicial collection costs apply per the Dutch Extrajudicial Collection Costs Decree (minimum €40)
  • β€’Statutory commercial interest continues to accrue (8% per year for B2B transactions)
  • β€’Your account may be permanently banned from IP Market and all PeaceWeb services
  • β€’The debt may be reported to credit bureaus in your jurisdiction
  • β€’For IP holders: pending payouts may be withheld to offset outstanding debts

IP Market β„’ (statutory name: PeaceWeb B.V.) reserves the right to pursue legal action in addition to collections procedures for significant outstanding amounts.

5.8 Chargebacks and Payment Disputes

If you dispute a charge with your bank or credit card company (a "chargeback") for a legitimate payment that was properly billed:

  • β€’Your account will be immediately suspended upon notification of the chargeback
  • β€’A chargeback penalty of 20% of the disputed invoice amount (minimum €25) will be added to your account
  • β€’An administrative fee of €15 will be charged to cover payment processor fees and dispute handling costs
  • β€’The original invoice amount remains due and payable
  • β€’For IP holders: payout privileges will be suspended and pending payouts may be withheld
  • β€’Services will not be reinstated until the original invoice, penalty, and administrative fee are paid in full

Before disputing: If you do not recognize a charge or believe there has been an error, please contact billing@ipmarket.io before initiating a dispute with your bank. We can often resolve billing issues quickly and avoid the penalties associated with chargebacks.

If a chargeback is filed fraudulently (for services that were properly delivered and used), IP Market reserves the right to:

  • β€’Permanently terminate your account without refund
  • β€’Pursue legal action for fraud
  • β€’Report the incident to fraud prevention databases and RIRs
  • β€’Transfer the full outstanding balance to collections
  • β€’Notify IP holders of any fraudulent activity affecting their resources

5.9 Lessee Responsibilities

Lessees must use leased IP resources only for legitimate, lawful business purposes, comply with all applicable RIR policies, maintain accurate WHOIS records with current contact information, respond promptly to abuse complaints (within 24 hours), implement appropriate security measures to prevent abuse, not engage in any activities prohibited by the Acceptable Use Policy, immediately cease BGP announcements upon lease termination, and not sub-lease or transfer IP resources without written authorization.

5.10 Lease Termination

Lessees may terminate a lease by providing at least 7 days' notice before the next renewal date. No refunds will be provided for the current billing period. Leases may be terminated immediately by IP Market or IP Holder for violation of the Acceptable Use Policy, non-payment or repeated late payments, abuse complaints or blacklisting issues, fraudulent activity or misrepresentation, or breach of these Terms.

Upon lease termination, lessees must immediately cease all BGP announcements of the leased IP resources, remove the IP addresses from all systems and configurations, and not attempt to use or route the IP addresses after termination. Continuing to announce or use IP resources after lease termination constitutes prefix hijacking and will result in immediate account termination, financial penalties up to €10,000 per incident, reporting to relevant RIRs and law enforcement, legal action for damages, and permanent ban from the platform.

6 Acceptable Use Policy

This Acceptable Use Policy defines the acceptable use of IP address resources, services, and infrastructure provided by IP Market β„’, statutory name PeaceWeb B.V. This policy applies to all users of the IP Market β„’ platform, including lessees, IP holders, and any third parties accessing resources through our network.

By using IP Market services, you agree to comply with this policy. Violations may result in immediate suspension or termination of services, financial penalties, and referral to appropriate authorities.

6.1 Prohibited Activities

The following activities are strictly prohibited when using IP Market services:

6.1.1 Illegal Activities

  • βœ•Any activity that violates local, national, or international laws
  • βœ•Fraud, identity theft, or financial crimes
  • βœ•Money laundering or terrorist financing
  • βœ•Drug trafficking or illegal substance distribution
  • βœ•Weapons trafficking or illegal arms dealing

6.1.2 Spam & Unsolicited Communications

  • βœ•Sending unsolicited bulk email (spam)
  • βœ•Operating open mail relays or proxy servers for spam
  • βœ•SMS/text message spam or robocalls
  • βœ•Email harvesting or address scraping
  • βœ•Forging email headers or sender information

6.1.3 Phishing & Fraud

  • βœ•Phishing websites or credential harvesting
  • βœ•Impersonation of individuals, companies, or organizations
  • βœ•Fake websites designed to deceive users
  • βœ•Social engineering attacks
  • βœ•Advance-fee fraud schemes

6.1.4 Malware & Security Threats

  • βœ•Distributing viruses, trojans, or malware
  • βœ•Operating command and control (C2) servers
  • βœ•Hosting exploit kits or drive-by download sites
  • βœ•Ransomware operations or extortion
  • βœ•Cryptojacking or unauthorized cryptocurrency mining

6.1.5 Network Attacks

  • βœ•Distributed Denial of Service (DDoS) attacks
  • βœ•Port scanning or network probing
  • βœ•Unauthorized access attempts (hacking)
  • βœ•IP spoofing or packet manipulation
  • βœ•DNS hijacking or cache poisoning
  • βœ•BGP hijacking or route manipulation

6.1.6 Harmful Content

  • βœ•Child sexual abuse material (CSAM) – zero tolerance
  • βœ•Terrorist content or extremist propaganda
  • βœ•Content promoting violence or discrimination
  • βœ•Hate speech targeting protected groups
  • βœ•Non-consensual intimate imagery

6.1.7 Intellectual Property Violations

  • βœ•Hosting pirated software, movies, or music
  • βœ•Operating illegal streaming services
  • βœ•Counterfeit goods distribution
  • βœ•Trademark infringement

6.2 Network & Technical Requirements

6.2.1 BGP & Routing

Users must maintain accurate BGP announcements matching authorized prefixes, ensure proper ROA (Route Origin Authorization) records, not announce prefixes without valid authorization, cease announcements immediately upon lease termination, and follow MANRS (Mutually Agreed Norms for Routing Security) principles.

6.2.2 WHOIS & Documentation

Users must maintain accurate and current WHOIS records, provide valid abuse contact information, respond to abuse inquiries within 24 hours, keep IRR records up to date, and maintain proper LOA documentation.

6.2.3 Network Security

Users are expected to implement BCP38/BCP84 anti-spoofing measures, maintain adequate security for their infrastructure, promptly address security vulnerabilities, not operate open resolvers, proxies, or relays, and implement appropriate firewall and access controls.

6.3 Abuse Handling

6.3.1 Abuse Reporting

To report abuse involving IP resources leased through IP Market, contact us at abuse@ipmarket.io. Please include: IP address(es) involved, timestamp (with timezone), description of the abuse, and supporting evidence (logs, headers, screenshots).

6.3.2 Response Requirements

Users must respond to abuse complaints within 24 hours of receipt, take reasonable action to address the complaint, provide updates on remediation progress, and implement measures to prevent recurrence.

6.3.3 Three-Strike Policy

For most violations, IP Market implements a graduated enforcement approach:

  • 1.First Violation: Warning and required remediation within 24 hours
  • 2.Second Violation: Service suspension until issue is resolved, possible financial penalty
  • 3.Third Violation: Account termination and permanent ban

Severe violations (CSAM, terrorism, major attacks) may result in immediate termination without prior warning.

6.4 Consequences of Violations

Violations of this Acceptable Use Policy may result in:

  • β€’Warning notices and required remediation
  • β€’Temporary service suspension
  • β€’Permanent account termination
  • β€’Financial penalties up to €10,000 per incident
  • β€’Forfeiture of deposits or withheld payments
  • β€’Reporting to RIRs, law enforcement, or industry groups
  • β€’Legal action for damages

7 Platform Availability & Service Level

IP Market strives to maintain high platform availability and reliability. However, we do not guarantee uninterrupted access to the Services. The platform may be unavailable due to scheduled maintenance (announced in advance when possible), emergency maintenance or security updates, third-party service provider outages, force majeure events, or technical failures or infrastructure issues.

For detailed information about our uptime commitments, support response times, and service credits, please refer to our Service Level Agreement. Except as specifically provided in our SLA, service disruptions, downtime, or unavailability do not entitle users to refunds, credits, or other compensation.

8 Intellectual Property Rights

All content, features, functionality, software, code, designs, graphics, logos, trademarks, and other materials on the IP Market β„’ platform are owned by IP Market β„’ (statutory name: PeaceWeb B.V.) or our licensors and are protected by international copyright, trademark, patent, and other intellectual property laws.

IP Market grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purpose in accordance with these Terms. This license does not include any right to modify, copy, distribute, or create derivative works, reverse engineer or decompile the platform, use automated tools to access or scrape the platform, remove or alter any proprietary notices, or use IP Market branding without written permission.

You retain ownership of any content you submit to the platform. However, by submitting content, you grant IP Market a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content as necessary to provide the Services.

9 Disclaimers & Limitation of Liability

IP Market operates solely as an intermediary marketplace. We do not own, control, or directly lease the IP addresses listed on the platform. IP Market is not responsible for the quality, availability, or performance of leased IP resources, routing issues, reachability, or technical problems with IP resources, compliance with RIR policies by users, abuse, blacklisting, or reputation issues with IP resources, disputes between lessees and IP holders, financial losses due to non-payment by lessees, or actions or omissions of users.

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

To the maximum extent permitted by applicable law, IP Market, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages. In no event shall IP Market's total liability exceed the amount you paid to IP Market in the 12 months preceding the claim, or €100, whichever is greater.

You agree to indemnify, defend, and hold harmless IP Market and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your violation of these Terms, your use of the Services, your violation of any third-party rights, or your violation of applicable laws or regulations.

10 Data Protection & Privacy

IP Market is committed to protecting your personal data in accordance with GDPR and other applicable data protection laws. Our collection, processing, and use of personal data is governed by our Privacy Policy. For business customers processing personal data through our Services, a separate Data Processing Agreement may be required.

11 Account Termination & Suspension

You may terminate your account at any time by submitting a termination request through the platform or contacting support at support@ipmarket.io. Account termination is subject to completion of all active leases or proper cancellation notice, settlement of all outstanding payments, and compliance with post-termination obligations.

IP Market reserves the right to suspend or terminate your account immediately, without prior notice, for violation of these Terms or any referenced policies, non-payment or repeated late payments, fraudulent activity or misrepresentation, abuse complaints or AUP violations, failure to complete KYC verification, suspicious or illegal activity, risk to platform security or integrity, or as required by law or legal process.

Upon account termination, your access to the Services will be immediately revoked, active leases will be terminated, outstanding payments remain due and payable, earned but unpaid balances may be forfeited if termination is due to Terms violations, and your data will be retained or deleted in accordance with our Privacy Policy and legal obligations.

12 Governing Law & Dispute Resolution

These Terms and any disputes arising from or relating to these Terms or the Services shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any legal action or proceeding arising from or relating to these Terms or the Services shall be brought exclusively in the competent courts of 's-Hertogenbosch, Netherlands. You irrevocably consent to the jurisdiction and venue of such courts.

Before initiating formal legal proceedings, parties agree to attempt good-faith negotiation to resolve disputes. Either party may request mediation through a mutually agreed mediator in the Netherlands. To the extent permitted by law, all disputes must be brought on an individual basis and not as part of any class, collective, or representative action.

13 General Provisions

These Terms, together with the Privacy Policy, Cookie Policy, Acceptable Use Policy, and any other policies referenced herein, constitute the entire agreement between you and IP Market regarding the Services. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term.

You may not assign or transfer these Terms or your account without IP Market's prior written consent. IP Market may assign these Terms without restriction. IP Market shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, pandemics, or shortages of transportation, facilities, fuel, energy, labor, or materials.

These Terms are provided in English. Any translations are provided for convenience only. In case of conflict, the English version shall prevail.
